1. Introduction
These Terms of Service ("Terms") govern your access to and use of the website and SaaS platform Clusterpilot.ai (the "Platform"), operated by:

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you may not use the Platform.
2. Eligibility
You must:
- Be at least 18 years old
- Have the legal capacity to enter into binding contracts
The Platform is available to both businesses and private individuals.
3. Account Registration
To access the Platform, you must create an account.
You agree to:
- Provide accurate and complete information
- Keep login credentials confidential
- Be responsible for all activities under your account
We are not liable for unauthorized access resulting from your failure to safeguard credentials.
4. Description of Service
Clusterpilot is a SaaS platform providing AI-assisted content creation, SEO tools, content clustering, rewriting functionality, and CMS integrations.
Features, limits, and capabilities depend on your selected subscription plan.
We may modify, update, or improve the Platform at any time.
5. AI-Generated Content
The Platform generates content based on user input.
You retain ownership of the content you create.
However:
- You are solely responsible for reviewing and verifying all generated content
- We do not guarantee factual accuracy
- We do not guarantee SEO rankings or performance outcomes
- You assume full responsibility for publication and use of generated content
AI-generated external links, citations, and references may contain inaccuracies. You must verify them before publication.
6. Intellectual Property
All rights, title, and interest in the Platform, including:
- Software
- Source code
- Prompts
- Algorithms
- Databases
- Designs
- Branding
remain the exclusive property of Stinis Media CommV.
You are granted a limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms.
7. Acceptable Use
You may not use the Platform to:
- Violate any law
- Infringe intellectual property rights
- Generate unlawful, defamatory, or fraudulent content
- Distribute spam
- Circumvent security features
- Reverse engineer the Platform
- Overload or disrupt infrastructure
- Abuse plan limits or exploit technical loopholes
We reserve the right to suspend or terminate accounts for violations.
8. Subscriptions and Billing
The Platform offers free and paid subscription plans.
Paid subscriptions:
- Are billed automatically per billing cycle
- Renew automatically unless cancelled
- Include usage limits based on plan
We reserve the right to modify pricing and plan features. Price changes apply to the next billing cycle.
9. Consumer Right of Withdrawal
If you are a consumer within the European Union, you have the right to withdraw from a distance contract within 14 days.
However, by creating an account and starting to use the Platform, you:
- Explicitly request immediate performance of the service
- Acknowledge that digital services begin immediately
- Expressly waive your statutory right of withdrawal once performance has started
This waiver is legally valid under Article VI.53 of the Belgian Code of Economic Law.
10. Fair Usage and Abuse
Usage limits apply according to your subscription plan.
If we detect:
- Excessive usage
- System abuse
- Attempts to bypass limits
- Exploitation of technical loopholes
we may:
- Temporarily throttle usage
- Suspend access
- Terminate the account
at our sole discretion.
11. Uptime and Availability
We aim to provide 99 percent service availability on a yearly basis.
However, we do not guarantee uninterrupted access. Downtime may occur due to:
- Maintenance
- Updates
- Security measures
- External service provider issues
12. Administrative Access
We may access user accounts strictly to:
- Provide support
- Investigate violations
- Resolve technical issues
- Protect platform integrity
13. Limitation of Liability
To the maximum extent permitted by law:
- We exclude liability for indirect, incidental, consequential, or punitive damages
- We exclude liability for loss of profits, rankings, revenue, or business opportunities
- Our total liability is limited to the total amount paid by you in the twelve months preceding the claim.
Nothing excludes liability that cannot legally be excluded under Belgian law.
14. Termination
We may suspend or terminate your account:
- For breach of these Terms
- For unlawful use
- For abuse of the Platform
- For non-payment
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle.
15. Enterprise and Custom Agreements
Enterprise customers, team accounts, white-label agreements, or API clients may be subject to separate contractual agreements. In case of conflict, the separate agreement prevails.
16. Changes to These Terms
We may update these Terms at any time. Updated Terms will be published on the Platform with a revised date. Continued use constitutes acceptance of the updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed exclusively by Belgian law. Any dispute shall fall under the exclusive jurisdiction of the competent courts of Belgium.
